Facebook as evidence

A plaintiff in Ontario has been ordered to produce his private Facebook pages so that the defendant in his case can examine them. John Leduc is suing for damages for personal injuries he suffered in a car accident, and claims that he has experienced a significant loss of enjoyment of life. The Ontario Superior Court of Justice ruled "It is reasonable to infer that his social networking site is likely to contain some content relevant to the issue of how Mr. Leduc has been able to lead his life since the accident ... to permit a party claiming very substantial damages for loss of enjoyment of life to hide behind self-set privacy controls on a website, the primary purpose of which is to enable people to share information about how they lead their social lives, risks depriving the opposite party of access to material that may be relevant to ensuring a fair trial."
